What you need to know about Copyright images

It may seem complicated, but it really isn't.  But just to be safe, let's learn about what you can and can't do with the images you receive from the sessions! 

5 things to know Photography copyright & Usage

1. What Is Copyright in Photography?

Copyrighted photographs are images created by a photographer and are automatically protected under copyright law from the moment they are captured. Copyright protection applies to original creative works—such as photographs—that are fixed in a tangible medium, whether physical or digital.

This protection covers both printed photographs and digital image files. Under copyright law, the photographer retains exclusive rights to their work, including the right to reproduce, distribute, display, and create derivative works (such as editing, retouching, or adding graphic elements).

Any use of a copyrighted photograph without the photographer’s permission—including printing, copying, posting online, displaying, or altering the image—constitutes copyright infringement.


2. Possession of Photos Does Not Equal Ownership

Receiving digital files or printed photographs does not transfer copyright ownership. The photographer who created the images remains the legal copyright holder unless ownership is explicitly transferred in writing.

This means that permission is required for any use of the photographs, including but not limited to printing, sharing on social media, editing, publishing on websites, or using the images for promotional or commercial purposes.


3. Photos Found Online Are Still Copyrighted

Images found online—whether on social media, websites, or search engines—are still protected by copyright law. Public visibility does not make an image free to use.

Always assume that a photograph is copyrighted unless you have written permission or a license from the photographer that clearly outlines how the image may be used or shared.


4. Always Ask for Permission

This cannot be emphasized enough: never print, post, reproduce, or modify a copyrighted photograph without written permission from the photographer.

A print release or usage license outlines what you are legally allowed to do with the images. This document protects both you and the photographer by setting clear expectations regarding image use, reproduction, and sharing.


5. What Rights Does the Client Have?

Clients have the right to negotiate and agree upon a usage license with the photographer. This license grants specific permissions for how the photographs may be used, such as personal printing, social media sharing, or other agreed-upon purposes.

All usage rights must be clearly defined in a written agreement prior to use. This ensures transparency and mutual understanding regarding where, how, and for how long the images may be used.


Final Notes

Copyright law can feel overwhelming, but it exists to protect creative work and the people who create it. Just as you would not want someone else profiting from or misusing your work, photographers rely on these protections to safeguard theirs.

I kindly ask that you always request permission before sharing or reproducing any photographs. As your photographer, I am very flexible with personal usage and provide each client with a print permission form, or I am happy to handle professional printing for an additional fee.
